Bought a set of Rockets (http://www.ebay.com/itm/2-RACING-ROCKET-14-X-6-WHEELS-VINTAGE-STREET-ROD-GASSER-CRAGAR-USA-/130633230017?hash=item1e6a58e6c1&item=130633230017 &pt=Motors_Car_Truck_Parts_Accessories&vxp=mtr#ht_ 500wt_922) off eBay. They were described as:

"THESE ARE RARE AND IN GREAT CONDITION, NO CURB RASH, DENTS, OR GOUGES. THEY ARE REALLY NICE CONDITION FOR THE ERA. CAPS INCLUDED.
LOOK AT THE PICTURES, YOU BE THE JUDGE OF HOW NICE THEY ARE."

I get them and one wheel has a sizable piece of chrome/coating that has peeled off.

When I as seller about it he says:

"To answer your question is, the wheels as stated were used in nice condition for the
era with pictures. Chrome on or off never paid attention to that!"

I then tried to negotiate a refund or reimbursement and have heard nothing again since Wednesday.

The only thing that will work against you is time. I would file a case now. If you paid by pay-pal that much better.

I did pay with PayPal. Are you saying file with Them rather that eBay?

File the claim with PAYPAL not ebay. Ebay claim is a joke. PayPal will get your money back. File it with a "not as described" case.

X2. Ebay claims system is a joke. If you file a Paypal claim, they will freeze his account and he will not be able to withdraw the money.

I think that the way the description reads, you're out of luck. Chrome was never described.

"YOU BE THE JUDGE OF HOW NICE THEY ARE"

I'm not saying it's right, but don't see that you have any way out of the purchase.

If you feel the item was misrepresented and you paid with a credit card through Paypal, return the item with delivery confirmation. Work with your credit card company to reverse the charges. That is the easiest way to go.

I get that but I really feel the ad was misleading. Of course I may be way off so any feedback I get here would be helpful. I also don't appreciate that I'm being ignored. I tried talking it out privately but no responses.

Darren, thats a real shame. Listen to Matt - he's an ebay hawk with great experience. If that fails you, I'd file a claim through your CC company.

The seller had no close up pictures of the chrome. From a distance, they look great and he states that the wheels look great in the description. He specifically does not mention the chrome condition because he knows there is something wrong with it.

There are two concerns here.... one, the "ask a question" feature would have beeen a great tool to use and ask the seller what the chrome condition was since it was not mentioned in the ad before purchasing.

Two, you bid without asking any questions and just went off the 2 sentences and 4 pictures the seller had listed. I would haver a hard time purchasing anything with just a minimal description and 4 pictures but thats just me.

In my opinion since the guy won't respond, I would just file the paypal claim and consider it a lesson learned.

The fact that he completely ignored chrome condition

I'd did ask a question about the lug pattern and with his response he again reinterated how nice they were. I guess that boosted my confidence in them. But yes I should have asked specifically about the chrome. It was foolish of me to think that the chrome condition was a no brainer based on the ad description. Indeed lesson learned and I tend to trust people more that I should. Thanks guys. I'll file the PP claim and see what happens. <<GRAEMLIN_URL>>/biggthumpup.gif

Darrin,

Recently, I had a problem with a seller over a NOS oil pressure gauge. After confering with the seller and no reasonable results, I filed a claim with eBay. It took 2 weeks to process and I provided information and photos to support my point. I was successful in getting my money back. They do seem to have a level of accountability they hold the seller to.

An opposing comment, I did buy a car that was terribly misrepresented. After trying to persue that one, I just had to put some salt on and eat it.

My point................it's a crap shoot. But, certainly worth the effort.

You have the option to upgrade it to a PayPal case.

I had a case filed with Ebay for an improperly described aluminum intake. I took pictures and sent them in with my complaint.
Ebay agreed with me and refunded all my money, including shipping charges, and let me keep the intake. I think the seller may have learned a lesson about trying to pull a fast one.

Rick,
Did that guy ever respond to his own thread over on Team Chevelle after you posted in it?

You saw that?
No, the guy fell off the face of the earth.
I couldn't believe he started a thread bashing me for complaining about his severely cracked intake, that he described as completely without cracks.
Here's a link to that thread.
http://www.chevelles.com/forums/showthread.php?t=317230&highlight=intake

My response to this guys bashing is on the 3rd page of that thread.

I would find out his name and post it here. I have found that people are really tough until you threaten to mention their name and tarnish their reputation. That will normally get you some action.

So now he is finally responding. In the two messages I have received from him I find if funny that he never even asked to see the pictures of the damage which I told him I had taken. I offered but nothing. Perhaps just me but that seems a little guilty.

Anyway, he is now caving in but saying he only wants to refund me the purchase price. I have to pay to ship them back. $50 to get them here and $50 to get them back...

Now that just doesn't seem right to me.

Darren, I agree with you 100%. But atleast this may be better than the alternative. Hope it works out.

To be honest, you don't have Wal Mart pay you for the drive back to return something you don't need.

PayPal's return policy states that you get initial shipping refunded back to you.

He also mentions that i could have seen all the detail in the pictures if I CTRL & + to zoom. But he fails to realize that his pics aren't high resolution so when magnified the quality is terrible.

Tell this guy that he will refund your entire amount or you will have Paypal reverse the charges. His mistake, so he should eat the freight back.
I had an unhappy buyer and I refunded his money and shipping, I also sent a "call tag" from UPS to pick up the package. Sometimes doing the right thing cost the seller a dollar.

Well I had to escalate the case for eBay to review and I am now getting 100% of my $ back. Not paying a dime.

Thanks for all the advice here. <<GRAEMLIN_URL>>/beers.gif
