I have read the requirements and obligations for listing on this site and have had no issue with them both buying and selling. I do not see a time frame that a buyer has to inspect and make a claim after receiving an item. I saw a reference made a couple weeks ago about it being 2 months in another post. I have refunded one buyer his money and told him to keep an item because it was my wrong in the listing on one item I have sold here in the past with no issue. The item in question here was sold January 2nd 2018 and shipped the next day and I just received a PM that there is an issue with it May 3rd 2018. The issue is the tail shaft bolt hole which I had pointed out in photos and description. The fact it needs rebuilt (bearings, seals, and syncros) which I did not point out because I did not tear it apart or use the transmission prior. I assumed with all photos showing grease, dirt, and grime someone would assume that prior to using it it would need freshened up. (my bad) We are working out an agreement between us but I think some clarity would help as to a time frame to what a sellers requirements are and a time frame to protect a buyer. I read the original listing. It clearly states that there is a "wallowed" out hole. Is that the issue the buyer has, or is it the fact that it should be freshened up? If the hole is the issue, I would say "no refund". I also would think that a transmission from 1967 would need to be freshened up, or at least double checked for wear and tear, before installing it.

My thoughts are that the buyer is buying a used part and with that used part, there are

responsibility's of the buyer to check and evaluate the part being bought. It is also the sellers

responsibility to let the buyer know that this is a used part and will need to be gone

through.Common sense will hopefully tell the buyer to go over the part. On this site it

seems that sellers are very good at passing good used parts to fellow members here...there

should be some type of time line for the buyer to look at a part and evaluate and let the

seller know what their thoughts are on the part in a timely manor. Just my .002!

Based on just the ad, and no other correspondences it is being sold as a 51 year old part with no known history or claim of functionality.. The seller did not rebuild or state "it was in my car and it shifted perfect and made no noise".

If the transmission is not rebuildable or then I would suggest the buyer and seller work it out.

If the buyer and seller want my input beyond what I stated please PM me.

You showed pics of the hole in question, and even removed the side cover to show the gear condition...I don't think I would expect anything more from a used trans, unless it was grenaded in some unrepairable way.

I will respond since this was my original post. The Forum's policy and general consensus is that buyers have 60 days to make a claim against a seller for item not as described or misrepresented. Long story short a request was made. I posted the topic for discussion. A counter offer was made. It was declined and agreed nothing was wanted or offered any longer. Thanks SYC and Steve. Larry
