Can you post a link to the auction?

Have the seller read the part about legal binding contract. Have him send a total and if he refuses contact ebay through their complaint links.

If he is the type that doesn't care about negative feedback you might be out.

Good Luck

Yes, you do. An eBay auction is a legal contract of sorts.

Contact the seller immediately and notify him/her that you
won the item fair & square. They could have stopped the
auction if they wanted to. Let the seller know that you
will file a fraud claim with eBay immediately if they do
not follow through. Don't let this lie dormant too long.

The item was for sale, and won by the highest bidder for $153.50.
I would contact Ebay,if that is you.

Josh,

Seller has just (1) feedback! There's your problem.
Someone offered him bigger $$ for the intake, so he's
going to turn you away. If you follow the links through
eBay, you can report the problem fairly easily. Don't
let this knuckle-head get away with this!

BTW, I didn't see anything on the auction where he notified
you, or anyone else that the item was already sold elsewhere. http://www.yenko.net/ubbthreads/images/graemlins/bs.gif

Not much. If you have the time, you can file a small claims suit against him, locally. Usually they are $35-$99 in most places and are heard by a justice of the peace. You do not need a lawyer. Pretty cool. Be prepared to lose some time and maybe some travel.

Upon hearing both sides, they can suspend him temporarily from participating in any future Ebay activities, and possibly Ban as well.
Try calling Ebay Customer Support too @ 1-888-749-3229 Mon.-Fri.7:30 AM-5:30PM Pacific time.

Mr70

I would phone him & try to resolve this first in a friendly manner, then if nothing happens, contact Ebay ASAP.
You won it fair & square, and he should honor that.

Yep, my vote to. In fact I would tell him why you are sending a postal money order. I just paid for a 6,000.00 car, all with postal money orders! They don't play.

3rd vote for US Postal money orders here. (I won't touch PayPal with a 10 foot pole, heard WAY too many horror stories)

Make sure that he has ti sign for it so he can't say he never got it. With USPostal money order send with United States Postal Service.

I still have all the paperwork from 5 years ago, when I got taken after paying with a postal money order. Everybody kept passing the buck, and nobody did anything for me. I guess $150.00 wasn't considered worthwhile for the US Postal Service, or the Florida officials to pursue. I got letters stating that they sent the complainant a letter, but received no reply, so "at this time we can be of no further help to you." I was dumbfounded. This kind of turned me of towards the US Postal Service.
